Kulbhushan Jadhav, an Indian citizen imprisoned in Pakistan, has not been given the right to appeal in the higher court. This information was given by the Defense Ministry of Pakistan during the hearing in the Supreme Court.

Actually, the hearing was going on in the Pak Supreme Court in the case related to the arrest of Imran Khan’s supporters. During this, the court asked the lawyer whether Kulbhushan Jadhav had the right to appeal and if he had, then why don’t Pakistani citizens have this right?

On this, the Defense Ministry lawyer said that Jadhav had no right to appeal.

According to a report in Pakistani newspaper Dawn, Jadhav was only granted consular access after the decision of the International Court of Justice (ICJ) in 2019. When there is a provision for consular access, the accused gets help through the High Commission.

Jadhav was tried in a military court in Pakistan. On 10 April 2017, the military court sentenced him to death on charges of espionage, terrorism and anti-national activities. India strongly condemned this decision and said that transparency was not maintained in this case.

In May 2017, India approached the International Court of Justice (ICJ) and accused Pakistan of violating the Vienna Convention. India argued that Jadhav was not given a fair trial and his rights were violated.

The ICJ had stayed Jadhav’s execution and ordered to ensure his safety until the final decision. In July 2019, the ICJ ruled in India’s favour and ordered Pakistan to reconsider Jadhav’s sentence. Pakistan has not taken any decision on this since then.

Pakistan claims- Jadhav was arrested from Balochistan​

On 3 March 2016, the Pakistani army said that it had arrested Kulbhushan Jadhav from Balochistan province. Pakistan had accused Kulbhushan of being involved in espionage and anti-national activities.

Pakistan had released a video in which Jadhav had allegedly admitted that he was working for the Indian intelligence agency RAW and was involved in spreading instability in Balochistan and Karachi. However, India had rejected it and said that this was a forced statement.

India said that Pakistan’s intelligence agencies kidnapped Jadhav from Iran. Jadhav was doing business in Iran after retirement.

Mufti who kidnapped Kulbhushan Jadhav dies​

Mufti Shah Mir, who helped in the kidnapping of Kulbhushan Jadhav, has been killed in Balochistan, Pakistan. He was shot dead by unknown gunmen in March. Mufti Mir had helped the Pakistani intelligence agency ISI in kidnapping Kulbhushan Jadhav from Iran.

He was coming out of the mosque after prayers on Friday night when bike-borne assailants ambushed him and shot him several times. According to a report in Pakistani newspaper Dawn, he was taken to a hospital after being shot, where he was declared dead.

Mufti Mir, involved in human trafficking and arms smuggling, was a member of the Islamic fundamentalist party Jamiat Ulema-e-Islam.
